Who we are
This website, HomesWithFernando.com, is operated by Fernando Topete, REALTOR® | West USA Realty. In this policy, “we,” “us,” and “our” refer to Fernando Topete. This policy explains what information this website collects, how it is used, and who processes it.
Information you give us
When you use a form on this website, we collect the information you choose to enter:
- Contact information: your name, phone number, and email address.
- Property and inquiry information: such as a property address, the property’s condition, your selling timeline, and any question or message you write.
- Form details: which form you used (for example, Sell My Home, Home Value, Cash Offer, or Ask Fernando), the page you submitted it from (including any campaign tags in the page address), and the date and time of your submission.
If you call, text, or email Fernando directly using the links on this site, those communications go through your own phone or email provider and are handled like any other call, text, or email.
Website and technical information
Like most websites, information is automatically processed when you visit, including your IP address, browser and device information (such as the user agent), and the pages you request. This information is processed by our hosting and security provider, Cloudflare, to deliver the website and protect it from abuse.
To limit repeated or automated form submissions, our server uses a one-way scrambled (hashed) version of your IP address to count recent submissions for a short period (about 10 minutes). It is not added to your contact record.
Our own website code does not set cookies, and we do not currently use advertising or analytics cookies.
Bot protection (Cloudflare Turnstile)
Our forms use Cloudflare Turnstile, an invisible security check that helps tell real visitors apart from automated bots. Turnstile runs in the background in your browser and processes limited signals such as your IP address, browser information, and the website you are using. This information is used for security, fraud prevention, and bot detection rather than for advertising by HomesWithFernando.com.
Cloudflare’s handling of this information is described in the Cloudflare Turnstile Privacy Addendum and the Cloudflare Privacy Policy.
Analytics and tracking
This website does not currently load third-party analytics or advertising tracking tools (such as Google Analytics or social-media pixels). If that changes, we will update this policy.
How we use your information
- To respond to your inquiry or question.
- To provide real estate services you ask about, such as discussing selling your home, preparing a home-value estimate (market analysis), or reviewing selling and cash-offer options.
- To follow up with you about your inquiry by phone, text message, or email.
- To keep records of inquiries and manage client relationships.
- To keep the website secure and prevent spam and abuse.
Texts and emails
Submitting a form on this website does not sign you up for automated marketing text messages or marketing emails. Fernando may contact you personally by phone, text message, or email to respond to your inquiry. If you would rather not be contacted a certain way, just let him know.
Service providers who process your information
We use the following service providers to run this website and respond to you. Information is disclosed to and processed by them only as necessary to operate this website, our CRM, and our communications, and to provide real estate services:
- BoldTrail (kvCORE): the customer relationship management (CRM) system Fernando uses through his brokerage and team. Form submissions are saved there as a contact record with your inquiry details so Fernando can follow up. BoldTrail may supplement contact records with publicly available information.
- FormSubmit (formsubmit.co): used to send a copy of form submissions to Fernando’s designated email account.
- Cloudflare: hosts this website and provides security services, including Turnstile bot protection and abuse prevention.
We may also disclose information when required by law, legal process, or governmental request, or when reasonably necessary to protect the rights, property, or safety of our clients, ourselves, or others.
Information submitted through the website may be accessible to authorized personnel and service providers involved in providing real estate services and operating our CRM.
We do not sell your personal information. Disclosing information to the service providers described above, only as necessary to operate this website, our CRM, and our communications, and to provide real estate services, is not a sale of your personal information.
Other websites
This website links to other websites that we do not control, and their own privacy policies apply. For example, the Search Homes buttons take you to a separate home-search experience provided through Fernando’s real estate team, where that site’s own privacy policy and terms may apply. Information you enter or create there (for example, if you register or save homes) is handled by that site. Links to West USA Realty, social media, and HUD also lead to sites with their own policies.
Data security
We use reasonable measures to protect information submitted through this website, such as encrypted (HTTPS) connections, keeping service credentials out of the website’s public code, and limiting the information sent to each service. No website, internet transmission, or storage system is completely secure, so we cannot guarantee absolute security.
How long we keep information
We keep inquiry information for as long as reasonably needed to respond to you, provide services, maintain business records, and fulfill legitimate business or legal needs. You may contact us to request deletion as described below.
Your choices
You can contact Fernando at any time to ask what information we have about you, to correct or update it, to ask that it be deleted, or to stop being contacted. We will review and respond to privacy-related requests as appropriate. Some information may need to be kept for legal or business record-keeping purposes.
Children
This website is intended for adults and is not directed to children. We do not knowingly collect information from children under 13.
Changes to this policy
We may update this policy from time to time. The updated version will be posted on this page with a new effective date.
